Terms of Service

Welcome to SendAndChill.

By purchasing, accessing, or utilizing our specialized, delegated email infrastructure setup and deployment services (the “Services”), Client agrees to be bound by these Terms of Service.

1. Scope of Services and Infrastructure Execution

SendAndChill provides fixed-fee, high-ticket B2B email infrastructure deployment and technical configuration. Our core deliverables include, but are not limited to:

  • Domain Name System (DNS) record management and propagation setup.
  • Sender Policy Framework (SPF) configuration and optimization.
  • DomainKeys Identified Mail (DKIM) setup and cryptographic key generation.
  • Domain-based Message Authentication, Reporting, and Conformance (DMARC) alignment and policy deployment.
  • Delegated email workspace platform setup and routing management.

All Services are executed on a fixed-fee, project basis as selected and purchased by the Client through our secure checkout system.

2. “Zero-Password” Delegated Access Model

SendAndChill strictly operates under a zero-password, delegated authorization protocol designed to maintain maximum security and compliance for business clients:

  • No Master Passwords: We will never ask for, require, or store your primary account passwords, master login credentials, or personal administrative logins.
  • Delegated Authorizations: Execution of Services requires the Client to grant temporary, scoped delegated administrative access through official third-party platform protocols (such as Google Workspace Delegated Admin or domain registrar delegate access).
  • Client Cooperation: The Client is solely responsible for initiating and granting required delegated access in a timely manner following checkout. Delays by the Client in providing necessary access do not modify project milestones or grant rights to service cancellation.

3. Payment Terms & Billing

All prices for SendAndChill Services are listed in USD (or converted currency as specified at checkout) and billed on a fixed-fee basis. Full payment is required upon checkout prior to the commencement of any technical or infrastructure setup work. All payment processing is securely managed via Stripe.

4. Refund Policy

Due to the immediate allocation of technical engineering resources, non-recoverable labor, and the custom digital nature of network infrastructure setup, all purchases are strictly final and non-refundable.

For complete details regarding our non-refundable policy and chargeback protections, please refer to our full Refund Policy, which is incorporated by reference into these Terms.

5. Deliverability Disclaimer and Operational Limits

SendAndChill provides professional technical compliance and domain authentication to ensure your email infrastructure adheres strictly to current internet engineering standards (RFCs) and major inbox provider guidelines.

  • Technical Authentication vs. Campaign Performance: We guarantee proper cryptographic and technical protocol configuration (SPF, DKIM, DMARC, DNS). However, inbox deliverability depends on external factors beyond our control, including sender behavior, cold outreach volume, message body content, domain reputation history, and recipient engagement.
  • No Guarantee of Specific Placement: SendAndChill explicitly disclaims any express or implied guarantees regarding specific inbox placement, open rates, response rates, or immunity from spam filters.

6. Third-Party Service Dependencies and Liability

Our Services rely on infrastructure and services provided by third-party platforms (including, but not limited to, Google Workspace, Microsoft 365, Cloudflare, Namecheap, and Stripe). SendAndChill is not liable for service outages, policy modifications, account suspensions, or technical disruptions initiated by these external third-party providers.

7. Limitation of Liability

To the maximum extent permitted by applicable law, SendAndChill, its owners, operators, and contractors shall not be liable for any indirect, incidental, consequential, special, or punitive damages—including loss of revenue, loss of data, campaign interruption, or reputational harm—arising out of or in connection with the use of or inability to use our Services.

In all events, SendAndChill’s total aggregate liability under these Terms shall not exceed the total amount paid by the Client to SendAndChill for the specific project giving rise to the claim.

8. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the operating jurisdiction of SendAndChill. Any disputes, controversies, or claims arising out of or relating to these Terms or the breach thereof shall first be attempted to be resolved through good-faith negotiation before seeking formal legal remedy.
